Recover your commercial rent arrears quickly and efficiently without the use of a court order and at no cost to you.
Your commercial tenancy agreement will normally give you the authority to use certificated Bailiffs such as Unity, at no cost to you, to collect overdue rent on your behalf. In the event of non-payment we are able to secure your debt against the tenants assets. All our costs are paid for by your tenant. Your rent only has to be one day late before you are able to use this method of collection.
When you instruct Unity to collect your rent arrears using this method, you do so under the ‘Laws of Distress Amendment Act’ and ‘Distress for Rent’ rules 1988.
To instruct us to act on your behalf all you have to do is download our ‘Rent Warrant Form’, compete it and fax it back. Upon receipt of your instruction we will visit your tenant, without notice within 24 hours. We will act in a discreet and professional manner, trying to maintain a good landlord/tenant relationship. We will either collect payment in full immediately or secure your debt against the tenants assets, allowing them time to pay (usually within 5 days), but that is at ours and your discretion.
Once we have received the payment of outstanding rent and our fees, the funds will be placed in a clients account. Once the funds have cleared, the full amount of rent owed will be forwarded to you within 24 hours, either electronically (same-day transfer) or in hard format in accordance with your wishes.
We will at all times work as part of the landlords team in trying to re-establish the landlord/tenant relationship and encourage the tenant to start communicating with the landlord.
Lease Forfeiture
In some cases the landlord may prefer to terminate the lease. Again this can be done without involving the courts. In most commercial leases, the landlord has the right to terminate the lease if rent has not been paid within a specified time. This time must be specified within the lease.
Again, to instruct us to repossess the premises all you have to do is download our ‘Repossession Form’, complete it and fax it to us. Upon receipt of your instruction, we will visit the premises outside normal working hours and obtain peaceful forfeiture and re-entry. Using the services of a skilled and fully insured locksmith, we will change the locks and lock the tenants out, leaving the premises secure.
Whilst on site we will complete a full inventory of the contents for the landlords information and security. We will display all the necessary notices and deliver the new keys to the landlord or their agent. If this process is chosen, the landlord will be liable for our costs and fees and will have to recover them from the tenant, together with any outstanding rent either directly with the tenant or through the courts.
Our personnel can also be employed to oversea the removal of their goods by the tenant, thus maintaining the landlords position and prevents any attempts of re-entry by the tenant. The landlord will be kept informed throughout the whole process of collection of rent or repossession, so that they can make informed judgements.
